TERMS OF USE – LOCKER ATOCHA
In accordance with the provisions of the General Data Protection
Regulation (GDPR), we inform you that your data will be processed in our files
for the purpose of maintaining and fulfilling the relationship with our entity,
including the sending of communications within the framework of said
relationship.
Additionally, your data may be transferred when necessary for the
development, fulfillment, and monitoring of the relationship with our entity or
in cases authorized by a law of equivalent rank. In accordance with the GDPR,
you may exercise your rights before PRODUCCIONES RUIDHER SL, NIF
B81914491, with its registered address at C/ ILLESCAS, 90, 28047 MADRID,
by providing a photocopy of your ID. The content of this communication, as well
as any attached documentation, is subject to confidentiality obligations and is
intended exclusively for its recipient. If you are not the intended recipient,
we request that you notify us and refrain from sharing its content with third
parties, proceeding to its destruction.
The information service provider must be aware that, in addition to the
information provided to service recipients through its "Privacy
Policy," it must include additional legal texts related to other mandatory
regulations. This includes, but is not limited to, general contracting
conditions, intellectual and industrial property, website terms of use, and
related liabilities. It must also take into account the provisions of Law
34/2002, of July 11, on Information Society Services and Electronic Commerce,
beyond Article 10 or to complete any necessary information related to this.
Furthermore, users are informed that LOCKER ATOCHA premises are
equipped with video surveillance cameras. These cameras are intended to
monitor the status of the lockers at all times, as well as the use made of them
by users or third parties accessing the premises, with the objective of
improving the service provided by LOCKER ATOCHA. All LOCKER ATOCHA
locations include appropriate notices regarding the monitored areas, in
compliance with the regulations in force on data protection.
GENERAL TERMS AND CONDITIONS FOR THE RENTAL AND USE OF LOCKER ATOCHA
LOCKERS
OBJECTIVE
These general terms and conditions regulate the rental of LOCKER ATOCHA
lockers (owned by PRODUCCIONES RUIDHER, S.L.) through the website www.lockeratocha.com (the "Website") as well as their use.
Additionally, these terms govern the contractual relationship between PRODUCCIONES
RUIDHER, S.L. (owner of the LOCKER ATOCHA lockers) and the User who
rents the LOCKER ATOCHA locker service. Hereinafter, PRODUCCIONES
RUIDHER, S.L. may be referred to interchangeably as PRODUCCIONES
RUIDHER, S.L. or LOCKER ATOCHA.
THE SERVICE
LOCKER ATOCHA offers Users
the possibility of renting any of its lockers for full calendar days (within
the operating hours established by LOCKER ATOCHA).
Users may store their luggage and belongings in LOCKER ATOCHA
facilities, inside the reserved locker(s), exclusively for the duration of the
contracted reservation period.
Once the booking process is completed, Users will receive a reservation
confirmation code, which will provide information about the assigned locker
number, the duration of the rental, and the access code or key to the locker,
as detailed in the section on Access and Reservations.
What types of lockers does LOCKER ATOCHA offer?
LOCKERATOCHA provides
three types of lockers:
- S: 37 cm (height) x 48 cm (width) x 58 cm (depth) –
Fits 1 carry-on suitcase + 1 small backpack.
- M: 47 cm (height) x 48 cm (width) x 58 cm (depth) –
Fits 2 carry-on suitcases or 2 small backpack +1 carry-on
suitcase
- XL: 85 cm (height) x 48 cm (width) x 58 cm (depth) –
Fits 1 large suitcases + 1 carry-on suitcase + 2 small backpacks or 3 carry-on
suitcases + 1 small backpack
What can a User store inside a locker?
Within the limits established in this document (see Section: Usage
Limitations), a User may store any number of items as long as they fit
within the specified dimensions and do not exceed the locker’s capacity.
How Can a User Check if There Are Available LOCKER ATOCHA Lockers?
Through the website www.lockeratocha.com, Users can check the availability of lockers for
their desired dates.
How Long Can a Locker Be Rented For?
Users can rent a locker for a minimum period of one day.
When Can a User Access Their Rented Locker(s)?
The locker rental service is accessible 24/7. Therefore, any User
who rents a locker for a single day will have access to it from 7:00 AM on
the reserved day until 6:59 AM the following day.
Once the rental period has expired, LOCKER ATOCHA is authorized
to open the locker and remove any stored items. However, LOCKER ATOCHA will
never open personal belongings or access their contents.
It is the User's responsibility to store their belongings
properly packed and not leave loose items inside the locker.
Any removed belongings will be stored on the premises for 7days,
during which time the User may claim them. After this period, the belongings
will be considered abandoned, and LOCKER ATOCHA will assume no
responsibility for them, reserving the right to dispose of them as it sees
fit, without any right for the User to make claims against LOCKER ATOCHA.
Once the User Has Stored Their Items, Can They Only Access the Locker to
Retrieve Them?
No, LOCKER ATOCHA lockers are a rental service. Users can access
their rented locker as many times as they wish or need to during the
rental period. If a User forgets something or needs to retrieve an item
throughout the day, they can do so without any issues during their reserved
time.
What Is the Price Per Locker/Day?
The rental price per locker is the amount displayed on the website
at the time of booking. Users may benefit from any promotions available at
the time of rental. The prices listed on the website include VAT and
correspond to the rental of one locker (depending on size) per full calendar
day.
How to Use the Lockers?
The lockers offered by LOCKER ATOCHA are fully automated.
Users can make a reservation through our website www.lockeratocha.com, providing their personal details, the number
of lockers they wish to rent, the size, and the rental period.
Once the reservation is complete, the User will receive a confirmation
of the booking, including the locker number(s) assigned and a security
code to access their locker(s). Therefore, the User will be able to access
their locker using the security code provided by LOCKER ATOCHA at the time
of booking.
What Can a User Do If They Experience an Issue with Their Locker?
In case of malfunction, lockout, or any other issue while using
the locker, the User can contact LOCKER ATOCHA's support service by
calling or WhatsApp to the following numbers:

Can a User Modify, Cancel, or Get a Refund for Their Reservation?
At LOCKER ATOCHA, we want to ensure your satisfaction with our
service. Therefore, we offer the following options:
- Modify
the reservation: Changes
must be made at least 24 hours before the start of the reserved
service. After this period, modifications will no longer be possible.
Modifications are subject to locker availability and may incur additional
charges due to banking fees.
- Cancel
the reservation:
Cancellations must be made at least 24 hours before the start of
the reserved service. After this period, cancellations will no longer be
possible. If a User has any questions regarding the cancellation policy
or requires further clarification, they can contact us at info@lockeratocha.com.
- Obtain a
refund: The refund will
be processed once the cancellation has been verified. The User will
receive the refund via the original payment method within a maximum
of 20 calendar days from the confirmed receipt of the withdrawal
request.
ACCESS AND RESERVATION
LOCKER ATOCHA will make its
best efforts to ensure that the Website remains available 24/7 under
optimal conditions and to guarantee its security as reasonably possible.
However, LOCKER ATOCHA is not responsible for any malfunctions,
temporary interruptions, or loss of content on the Website caused by third
parties, unforeseen events beyond LOCKER ATOCHA’s control, accidental
circumstances, or force majeure.
LOCKER ATOCHA reserves the
right to temporarily suspend access to the Website when necessary for maintenance
work, making every effort to ensure that the interruption is as brief as
possible with minimal impact on Users.
To rent a LOCKER ATOCHA locker, the following requirements must
be met:
- Be at least 16
years old.
- Accurately and
truthfully complete all required fields in the RESERVATION section
of the Website, including:
- Full
name, phone number, email, reservation date, rental duration, number of
lockers (and size), and payment details depending on the selected payment method.
- Accept the general
terms and conditions for renting and using the lockers.
- Accept the privacy
policy of PRODUCCIONES RUIDHER S.L., the owner of LOCKER ATOCHA
lockers.
Once the reservation process is completed, the User will receive a
confirmation email with details including the assigned locker number(s),
the reserved days, and the access code(s) for the locker(s).
LOCKER ATOCHA reserves the
right to limit, relocate, or cancel reservations in the event of mechanical,
electrical, or general maintenance issues, without Users being entitled to
any compensation.
If a User encounters an issue accessing their locker when
retrieving their belongings, they must immediately notify LOCKER ATOCHA
by calling or WhatsApp to the following numbers:

LOCKER ATOCHA will work to
resolve the issue as quickly as possible, but it is the User’s responsibility
to allow enough time to collect their belongings.
If the issue is not resolved within a reasonable time, LOCKER ATOCHA
will cover the shipping costs to send the User’s belongings to the provided
address, only if the User had to leave without their belongings due to the
malfunction. The User will not be entitled to claim any additional
damages or compensation.
USER OBLIGATIONS AND RESTRICTIONS ON LOCKER USAGE
By renting a locker from LOCKER ATOCHA, the User agrees to comply
with the following obligations, without limitation:
- Use only
the reserved locker(s) solely
for storing personal belongings that need to be temporarily kept in
a secure location.
- Do not
use or place luggage in an unreserved locker without making a valid reservation or ensuring
that it is the assigned locker, confirmed through the reservation code.
- Verify
the size of luggage before making a reservation to avoid overloading the locker. No claims or
refund requests will be accepted if the luggage exceeds the locker’s
dimensions.
- Overloading
the locker or placing items outside the reserved space is strictly
prohibited. It is forbidden
to store luggage in an unreserved locker or one that has not been
confirmed at the time of booking.
- Use the
locker responsibly. The User
must not overload it and must ensure it is properly closed before leaving
the premises (after storing or retrieving items).
- Immediately
report any malfunction or irregular situation regarding the lockers by calling or WhatsApp to
the following numbers:

For example, if the reserved locker is occupied by
another User’s belongings, the User must not remove the forgotten items.
Failure to comply with this obligation may result in a penalty of up to €500.
- Do not
use the lockers for illegal or unauthorized purposes. In particular, Users must not store items that
are illegal to possess or trade, such as stolen goods, drugs,
pornographic or degrading materials, etc.
- Ensure
all belongings are properly packed.
- Do not
store any item that requires a license (e.g., firearms) without the necessary
authorization.
- Do not
store hazardous or contaminating materials, such as flammable objects or dangerous
substances.
- Do not
use lockers to store animals or any living beings.
- Do not
store food, unless it is sealed
and non-perishable, ensuring it does not spill, stain lockers, or
produce odors inside the LOCKER ATOCHA premises.
- Do not
share your security code with third parties. The User is fully responsible for any breach of
this obligation and its consequences.
- Do not
use the lockers to store goods meant to be collected by a third party. The lockers must not be used for goods
exchange or trade between individuals, as this use is not authorized
by PRODUCCIONES RUIDHER, S.L.
- Access
and remain in the premises only to use the rented locker. The User must not stay longer than necessary
to store or retrieve items.
- Do not
eat or drink inside the premises.
- Retrieve
all stored items before 06:59 AM on the last day of the rental period.
- Leave the
locker in the same condition as found and report any issues related to the
lockers or their condition by emailing info@lockeratocha.com.
- Do not
take photos or videos inside the LOCKERATOCHA premises, especially of the security mechanisms.
- Do not
store valuables such as money,
jewelry, electronic devices (tablets, laptops, TVs, etc.), or identification/travel
documents (e.g., passports, ID cards, tickets). Users must take all
necessary precautions to ensure they have not left any important documents
or valuables in the locker.
LOCKER ATOCHA is not responsible for any missed flights, trains, or other travel disruptions caused by
storing travel documents or tickets in the lockers. Additionally, LOCKER ATOCHA
is not liable for the loss of any item valued over €1000. Consequently, it
is the User’s sole responsibility if they store valuable or essential
items in the lockers against these General Terms and Conditions.
CONSEQUENCES AND USER LIABILITY FOR NON-COMPLIANCE
The User must indemnify PRODUCCIONES RUIDHER, S.L. for any
damages resulting from the User’s failure to comply with the obligations
established in this contract.
Failure to Vacate the Locker on Time
If the User does not empty the rented locker(s) by the rental
expiration date, PRODUCCIONES RUIDHER, S.L. will be authorized to
open the locker(s) and remove the stored items to free up space for other
customers. The removed items will be temporarily stored, and PRODUCCIONES
RUIDHER, S.L. will attempt to contact the User to arrange their return (at
the User’s full expense).
If 7 days pass without successful contact or without the User
reaching out, the belongings will be considered abandoned, and PRODUCCIONES
RUIDHER, S.L. will dispose of them at its discretion, depending on the
nature of the items.
For each day the locker remains occupied beyond the rental
period, the User will be charged a daily fee equal to the standard locker
rental rate. Additionally, a €100 penalty will be imposed,
regardless of PRODUCCIONES RUIDHER, S.L.’s right to claim further damages.
If the User does not retrieve the items in person, PRODUCCIONES
RUIDHER, S.L. will arrange shipping at the User’s expense. The User
must pay in advance:
- €30 per
item for domestic
shipping (within Spain).
- €75 per
item for international
shipping (outside Spain).
Once PRODUCCIONES RUIDHER, S.L. hands the items over to the
shipping carrier, the User assumes all risks associated with
transportation.
If 10 calendar days pass after PRODUCCIONES RUIDHER, S.L.
notifies the User of the amount due for shipping and no payment has been
received, the items will be considered abandoned and disposed of
accordingly.
Failure to Properly Use the Lockers
PRODUCCIONES RUIDHER, S.L. reserves the
right to remove any prohibited items that violate locker usage
regulations. In such cases, PRODUCCIONES RUIDHER, S.L. may contact law
enforcement and report the violation, as well as dispose of the
prohibited items.
The User is fully responsible for any items placed inside the
locker.
The removal of prohibited items will result in a €150 penalty,
in addition to any damages caused, for which the User will be liable.
Damage to Lockers Caused by Users
The User is fully responsible for any damage or deterioration
caused to the lockers due to improper or negligent use. The User must
compensate PRODUCCIONES RUIDHER, S.L. for any physical damage as well as
for loss of revenue due to the locker being out of service.
Specifically, the responsible User will be charged:
- A daily
rental fee for each day the
locker is out of service.
- Repair or
replacement costs, which
will be €1,500 in the event of replacement, in addition to any
other damages incurred.
Payment of Penalties
All penalties outlined in this section must be paid using the
same payment method the User used when booking the service or via bank
transfer to an account designated by PRODUCCIONES RUIDHER, S.L., if
requested by the User.
The User expressly authorizes PRODUCCIONES RUIDHER, S.L. to
charge the applicable penalties directly to the payment method used at
the time of booking.
OBLIGATIONS OF LOCKER ATOCHA
LOCKER ATOCHA is committed to keeping the locker service active and
making the locker(s) rented by the User available in good working condition
for the duration of the rental period.
Additionally, LOCKER ATOCHA will address any issues that may arise as
quickly as possible. In the event of an incident, to protect the stored
items, LOCKER ATOCHA reserves the right to relocate the deposited items
to another locker or a storage facility.
LIMITATION OF LIABILITY OF PRODUCCIONES RUIDHER, S.L.
LOCKER ATOCHA provides a locker rental service but does not
assume responsibility for safeguarding the deposited items. The User is
solely responsible for the belongings placed inside the rented lockers.
LOCKER ATOCHA’s liability is limited to the duration of the locker
rental period. Therefore, LOCKER ATOCHA will not be held responsible
for any damage or loss of the User’s belongings that occurs outside the
reserved rental period.
However, in the event of theft, LOCKER ATOCHA has an insurance
policy that covers losses up to €500 per locker.
This insurance does not cover the loss of:
- Cash, jewelry,
precious stones or metals
- Watches, plasma
screens, and other technological items (LCD devices, GPS
navigators, mobile phones, computers, tablets)
- Artwork,
antiques, memory cards, or any storage device containing data or images
CLAIMS AND COMPLAINTS
If the User believes they have a reason to file a complaint, they may do
so by sending an email to: info@lockeratocha.com.
LOCKER ATOCHA will make every effort to resolve the issue and
find a satisfactory solution for all parties.
If the User is not satisfied with LOCKER ATOCHA’s response, they
may submit an official complaint through the consumer protection
authorities of the Community of Madrid.
APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions are governed by Spanish law.
Both parties agree to submit to the jurisdiction of Spanish courts for
any disputes arising from this contract.
